Scope

These Terms apply to Community Users using Cave31 to browse, discover, save, enquire about or negotiate for artwork and related content.

Definitions

Cave31, we, us or our means the business operating the Cave31 website and associated gallery services. Platform means the Cave31 website and associated online services. User means any person accessing or using the Platform.

Community User means a User acting as a visitor, community member, prospective buyer, collector or other non-seller participant. Professional User means a User acting as an Artist, Seller, artwork owner or other person authorized to use Cave31's professional listing or transaction facilities.

Artist means the creator of an Artwork. Seller means the person or entity having lawful authority to offer an Artwork. Artwork includes an original artwork, edition, print or other artistic work accepted for listing by Cave31. Listing means information concerning an Artwork displayed through the Platform. Offer means a price or commercial proposal submitted through Cave31's negotiation or enquiry facilities.

Acceptance and Eligibility

By accessing or using the Platform, a User agrees to the terms and policies applicable to the services being used. A person entering into a binding transaction outside the Platform must be legally capable of doing so under applicable law.

Users must provide materially accurate information where requested and are responsible for activity conducted through their accounts. Cave31 may restrict, suspend or terminate access where reasonably necessary for security, fraud prevention, legal compliance, enforcement of these Terms, protection of Users or protection of the Platform.

Role of Cave31

Cave31 operates an art gallery and online art discovery platform. Depending upon the Artwork and available facilities, Cave31 may display Artwork for discovery or enquiry, facilitate communication between prospective buyers and Sellers, support negotiation or enquiry workflows, review or moderate Listings, or provide administrative support where separately agreed.

A Listing does not imply that Cave31 owns the Artwork unless Cave31 is identified as the Seller. Where another person is the Seller, that Seller remains responsible for lawful authority to offer the Artwork and for the accuracy of material information supplied about the Artwork.

Cave31 may determine which enquiry, negotiation or other facilities are available for a particular Artwork or Seller based on legal, regulatory, tax, operational, risk or other reasonable requirements. Nothing in these Terms excludes responsibilities imposed directly upon Cave31 by applicable law.

Platform Content and Guidance

Cave31 may provide curated selections, editorial notes, search rankings, recommendations, artist classifications, pricing guidance, negotiation guidance and automated or AI-assisted discovery features. These features assist discovery and may involve editorial judgment, algorithms or automated processing. They do not constitute certification of artistic merit, financial or investment advice, or a guarantee of authenticity, sale, price appreciation or future market value.

Acceptable Use

• Users must not commit fraud or impersonation.
• Users must not knowingly provide materially false or misleading information.
• Users must not infringe intellectual-property rights.
• Users must not interfere with Platform security or operation.
• Users must not scrape or systematically extract Platform content without authorization.
• Users must not manipulate Offers, reviews, rankings or transactions.
• Users must not harass other Users or use the Platform for unlawful purposes.

Community Accounts and Discovery

Community Users may browse public content and, where available, register to use community features such as saved content, enquiries, Offers, wish lists or other facilities. Registration does not guarantee access to every feature.

Community Users are responsible for maintaining accurate contact information and reasonable security of their accounts.

Artwork Information

Artwork Listings are intended to provide material information reasonably necessary for discovery and enquiry decisions. Artwork images should represent the work reasonably accurately, but colour, texture, scale and appearance may vary because of photography, lighting, display technology and device settings.

Users should rely on stated physical dimensions and descriptions rather than apparent screen size. Information supplied by independent Sellers may be reviewed by Cave31 but remains subject to authenticity and Seller-responsibility provisions.

Pricing and Enquiry Information

Unless expressly stated otherwise, the Seller determines or approves the displayed price or indicative price. Cave31 may provide pricing recommendations or curatorial guidance. Such guidance is advisory and is not a valuation or guarantee of future value.

Taxes, charges or other commercial details may depend on the final arrangement and should be confirmed through the relevant enquiry process. Cave31 may correct an obvious pricing, tax, technical or Listing error.

Offers and Negotiation

Certain Artworks may be marked Open for Negotiation. Where enabled, a Community User may submit an Offer within limits permitted by the Platform. An Offer does not by itself complete a sale.

• The Seller may accept or reject an Offer.
• An unanswered Offer expires automatically after 15 days.
• Cave31 may restrict abusive, repetitive or bad-faith Offers.
• Artwork availability is not guaranteed merely because an Offer remains pending.

The Platform may permit Offers down to a system-defined submission threshold, currently intended to allow an Offer up to 50% below the displayed price. This is only a submission limit and does not indicate that such an Offer is reasonable or likely to be accepted.

Enquiries and Independent Transactions

Some Artworks may be available through enquiry-led communication. An enquiry allows communication about a potential transaction and does not itself create a binding transfer.

The availability of enquiry may result from legal, regulatory, tax, operational, Seller-specific or other Platform requirements. Cave31 need not publicly disclose the internal reason for assigning a particular process unless disclosure is legally required.

Unless expressly stated otherwise, Cave31 does not provide transaction guarantees for transactions independently concluded outside Cave31's authorized process.

Copyright

Ownership of a physical Artwork and ownership of copyright are separate. Acquiring a physical Artwork does not transfer copyright, reproduction rights, merchandising rights or other intellectual-property rights unless expressly transferred through a separate written agreement.

Privacy, Suspension and Liability

Personal information is handled according to the Privacy Policy. Cave31 may suspend or terminate an account, Listing or service where reasonably necessary because of material violation of these Terms, suspected fraud or unlawful conduct, authenticity or ownership concerns, security risks, abuse of Users or Platform facilities, or legal requirements.

Cave31 will exercise reasonable care in operating the Platform but does not guarantee uninterrupted or error-free availability. Nothing limits or excludes liability or consumer rights that cannot lawfully be limited or excluded.

Complaints, Law and General Terms

Users may raise complaints through Cave31's published contact or grievance mechanism. Complaints should contain sufficient information to identify the relevant Artwork, Listing, Offer, enquiry or account issue.

These Terms are governed by the laws of India. Subject to mandatory consumer or other statutory jurisdiction, disputes are subject to competent courts having jurisdiction in Kolkata, West Bengal.
