Artwork Information
Artwork Listings are intended to provide material information reasonably necessary for discovery and enquiry decisions. Artwork images should represent the work reasonably accurately, but colour, texture, scale and appearance may vary because of photography, lighting, display technology and device settings.
Users should rely on stated physical dimensions and descriptions rather than apparent screen size. Information supplied by independent Sellers may be reviewed by Cave31 but remains subject to Seller responsibility.
Seller Authority and Authenticity
A Seller represents that the Seller has lawful authority to offer and transfer the Artwork and that information supplied concerning authorship, provenance, edition and authenticity is not knowingly false or misleading.
- A Professional User must have lawful authority to offer and transfer submitted Artwork.
- A Professional User must provide materially accurate information.
- A Professional User must disclose authorship, medium, dimensions, edition where applicable, material condition information and relevant restoration or alteration.
- A Professional User must provide provenance or authenticity information reasonably requested by Cave31.
Cave31 Review
Cave31 may request supporting documentation or information at any time and may suspend a Listing or transaction where reasonable authenticity, ownership, legal or provenance concerns arise.
Cave31 may undertake reasonable review or curation but does not guarantee independently supplied provenance or attribution unless Cave31 expressly provides a written guarantee for the particular Artwork.
Misrepresentation
Deliberate misrepresentation, counterfeit Listings or unauthorized sales may result in removal, account termination, cancellation of transactions and other appropriate action.
Physical Artwork and Copyright
Ownership of a physical Artwork and ownership of copyright are separate. Acquiring a physical Artwork does not automatically transfer copyright, reproduction rights, merchandising rights or other intellectual-property rights unless expressly transferred through a separate written agreement.
Artists and Sellers retain whatever intellectual-property rights they lawfully hold.
Licence to Cave31
A person uploading or providing Artwork images or related content confirms that they have authority to permit their use and grants Cave31 a non-exclusive licence to store, reproduce, resize, reasonably crop, display and use the material for operation of the Platform, promotion of the Artwork, Cave31 editorial and curatorial activities, exhibitions, catalogues, marketing and social-media communication.
This licence does not transfer copyright to Cave31. Cave31 may retain reasonable archival records of sold, expired or removed Listings for transaction records, legal compliance or legitimate gallery/history records.
Complaints
Users may raise authenticity, provenance, copyright or intellectual-property complaints through Cave31's published contact or grievance mechanism. Complaints should contain sufficient information to identify the relevant Artwork, Listing, User or alleged right.
